Background of the Illegal Tip Pooling Case
WHD investigators determined that the employer engaged in illegal tip pooling when it used servers’ tips to pay bussers’ wages. According to the WHD’s attorneys, the employer violated several federal laws under the FLSA. In detail, the employer’s illegal activities included the following:- Requiring servers to surrender 10 to 15 percent of their tips on any given shift to pay for bussers’ wages
- Paying straight time to certain kitchen employees for hours worked over 40 in a workweek, in violation of federal overtime law
- Illegally paying servers time-and-a-half based on their cash wage of $2.83 an hour for hours over 40 in a workweek
- Interfering with the WHD investigation by telling employees to lie about the employer’s illegal tip pooling and other unlawful pay practices
Illegal Tip Pooling Under the FLSA
In 2020 and 2021, the DOL introduced a series of rules updating existing regulations to protect tipped workers. Specifically, these rules expressly prohibit employers from stealing tips. The DOL’s tipped worker final rule includes the following regulations:- An employer cannot keep employees’ tips under any circumstances; managers and supervisors also may not keep tips received by employees, including through tip pools.
- Additionally, any employer that collects tips to facilitate a mandatory tip pool generally must fully redistribute the tips within the pay period.
