NFIB Becomes Second National Group to Sue NLRB Over Poster Mandate

The National Federation of Independent Business (NFIB) has become the second nationwide business group to file a lawsuit against the National Labor Relations Board (NLRB) and its recent ruling that businesses must post an employee rights notification under the National Labor Relations Act (NLRA).

“With this latest rule, the NLRB has gone too far, passing a mandate that vastly exceeds its authority—largely at the cost of the small-business community,” said Karen Harned, executive director of NFIB’s Small Business Legal Center.

The National Association of Manufacturers (NAM) was the first to file suit to stop the NLRB action, using the same argument that the board exceeded its authority in issuing the mandate.

The 11-by-17-inch poster must be displayed by almost all American businesses with few exceptions. It is available now on the Personnel Concepts Web site. The poster mandate goes into effect Nov. 14.
