Independent Contractor Final Rule
The first Notice of Proposed Rulemaking (NPR) proposes the withdrawal of the Independent Contractor Final Rule. The final rule, issued by the DOL on January 7th, 2021, originally had an effective date of March 8th, 2021. Since that time, however, the DOL pushed the effective date of the rule to May 7th, 2021. The NPR lists several reasons as to why they are considering rescinding the final rule. These reasons include the following:- The rule adopted a new “economic reality” test. This test would determine whether a worker is an employee or an independent contractor under the FLSA.
- Courts and the department have not used the new economic reality test. Additionally, the current FLSA text and longstanding case law does not support the test.
- The rule would narrow or minimize other factors traditionally considered by courts. These factors would make the economic test less likely to establish that a worker is an employee under the FLSA.
